Yes, but people design their documents first and write their schemas later.

The way around the limitation on derivation by restriction is not to use
unqualified local elements, it is to use global elements.

(The real problem comes, of course, when you try to restrict a content model
that wasn't written to make restriction possible - i.e. one that
unthinkingly uses qualified local elements).
