This is a XML prolog (though similar in syntax to processing instruction). I don't think it's correct to change how we specify XML prolog information. It might cause lot of problems in the XML world. As Michael Glavassevich wrote, this already part of DOM. So for me, DOM problem is solved. XSLT (2.0) spec does offer instructions (e.g., part of xsl:output) to generate XML prolog in the serialized output. But XML prolog is not part of XPath data model.
