I just have not done a > count() on it yet. It looks like you are not passing in a .NET string with XML markup but rather an XPathDocument or an XmlDocument or an XPathNavigator. To find out why the count does not give you the result you are looking for you need to provide details of a case that fails so that we can reproduce that.
