MSXML supports a node-set extension function, but not in the EXSL
namespace, rather in a Microsoft namespace
urn:schemas-microsoft-com:xslt so you would use e.g.
<xsl:stylesheet
xmlns:ms="urn:schemas-microsoft-com:xslt"
xmlns:xsl="http://www.w3.org/1999/XSL/Transform"
version="1.0"
exclude-result-prefixes="ms">
then use
ms:node-set($var)
instead of
exsl:node-set($var)
As for those characters, with XML (and XSLT is XML) you can use numeric
character references e.g.
<xsl:param name="p1" select="'
'"/>
