Basically the idea is that xml declaration reflects XML documen't 
encoding. String are always UTF-16 encoded in .NET, so is XML 
declaration. You propose to have UTF-16 encoded document, XML 
declaration of which says it's UTF-8, hmmm. I wouldn't cheat with it 
without a real necessity.
